Tier 3 Sex Offender Registry Removal

With the recent modifications to the Michigan Sex Offender Registration Act (SORA) that took effect on July 1, 2011, the chance for Tier 3 sex offenders to get off the registry has now become possible in a few very specific instances.

The state of Michigan classifies each convicted sex offender into one of three Tiers. Tier 3 sex offenses are considered by the state to be the most serious of all sex crime convictions in the state. Given the recent changes to SORA, there has been confusion among sex offender registrants as to which Tier they belong to. A Tier 3 sex offender has generally committed one of the following crimes:

• Subsequent Tier I or Tier II crimes committed by someone who has already been convicted of a Tier I or Tier II crime
• CSC 1st degree
• CSC 3rd degree
• CSC 2nd degree against a victim under age 13
• CSC 4th degree committed by defendant aged 17 or older against a victim under age 13
• Assault with intent to commit penetration (CSC 1st degree or CSC 3rd degree)
• Assault with intent to commit CSC 2nd degree against a victim under age 13
• Gross indecency against a victim under age 13
• Kidnapping against a minor
• Kidnapping a victim under age 14
• A substantially similar offense to the ones described above under the laws of another jurisdiction
• An attempt or conspiracy to commit any of the above

Tier 3 offenders are listed on the public website. They must register in-person four times per year with the Michigan State Police or a local law enforcement agency. This registration occurs between January 1 and January 15, between April 1 and April 15, between July 1 and July 15, and between October 1 and October 15. Tier 3 registration lasts for a lifetime unless the offender petitions for and is granted a length reduction 25 years after being on the sex offender registry.

I am ready for the next step. I want to read the chart and determine my eligibilty for Removal from the Registry. -->
